New York State Police say they have wrapped up an investigation into allegations that a Vestal School District teacher assaulted a 10 year old student, causing serious injuries.

The New York State Child Abuse Hotline was contacted March 18 and family and friends have taken to social media to publicize the allegations.

The Tioga County District Attorney reviewed the case to decide if charges should be filed against the Tioga Hills Elementary School teacher.

While Troopers say they expected the DA’s office to conclude its investigation April 8, Vestal Schools Superintendent Mark LaRoach sent a letter to parents April 6 saying the teacher had been exonerated.

The family of the student has retained an attorney.

Following the alleged incident, the boy’s mother took the child to a hospital for treatment.

Attorney Ronald Benjamin says the boy suffered a possible shoulder separation.

Benjamin says a notice of claim has been filed against the school district and a lawsuit is expected to follow in a couple of months.
